"Epic Charters" and associate brands are Trading Under "Distinct Buisness Services Co Ltd".

PAYMENTS:

Charter Fee:
* Full invoicing details and payment details have been provided in the separate invoice, which was sent out in conjunction with the Yacht Charter Contract.
* Payment shall be made without any deduction or charges to the company and it shall be deemed paid only when cleared to the specified account as per the invoice:
* Payment will be made in Thai Baht unless the company pre authorises the customer to pay in an alternative currency - the balance of the charter must still be equal too and not less than the Thai Baht value as specified

Credit Card Payments - we have three options

1. In Person Credit Card payment
* Credit Card on arrival (After the Security Deposit has been Paid to secure the booking)
* If we are required to visit the cleints then a charge of 1,000 THB will be applied for time, transportation and convieninece to the clients
* There will be a surcharge of 3%

2. Credit Card payment via PayPal
* Payment must be made 7 days prior to the Charter date to ensure the funds are cleared
* A PayPal Invoice is sent directly to the clients
* This service has a 5% Surcharge

3. Credit Card Payment via Omise ONLINE Solution:
* Payment must be made 7 days prior to the Charter date to ensure the funds are cleared
* An Omise Invoice is sent directly to the clients
* There is a Surcharge of 4%

Please note we can not take AMEX - only VISA and MAstercard and some other banks

NB:
The booking is ONLY confirmed when the Charter fee or the Security Deposit is received.
Full Payment must be received PRIOR to the Charter Date, unless pre authourised by the company
All bank charges and interbank transfer fees are the responsibility of the clients.
The total balance received must be the same as the invoice.

CANCELLATIONS & RETURNS POLICIES

1. Obligations of the Owner

Delivery of the Yacht
The Owner shall deliver the chartered yacht to the Charterer at the start of the agreed charter period in a clean and seaworthy condition, with full tanks of water, fuel and gas.

Should the Owner be unable, even through no fault of his own, to deliver the chartered yacht or a similar yacht at the commencement of the charter period, he is obliged to reimburse a pro-rata sum of the charter fee - depending on the date of the cancellation and the clients charter date.

Should the Owner be unable to deliver the chartered yacht or a similar yacht after 72 hoursí notice prior to the commencement of the charter period, the Charterer is then entitled to cancel this agreement, this cancellation being in writing to the Owner. In this event, immediate refund of the full charter fee is payable and there will be no further rights or claims for compensation.

2. Obligations of the Charterer

Once this charter agreement has been signed, cancellation thereof will incur the following penalties:

* More than 12 weeks before the charter date, 25% of the total charter fee
* Between 12 and 8 weeks before the charter date, 50% of the total charter fee
* Between 8 and 4 weeks before the charter date, 80% of the total charter fee
* Within 4 weeks of the charter date, 100% of the total charter fee
* In each case, an additional administration fee of EUR 150.- is applicable

3. The Owner/Broker is entitled to cancel the agreement should the Charterer fail to meet his payment deadlines.

YACHT INSURANCE

We need to have the following details to ensure that you are covered as required by Thai law during the charter

  • Passport Number
  • Country of Origin
  • Age
  • Full Name

NB: If we do not have these details prior to the charter date we are not allowed to depart on the charter.

HOTEL TRANSFERS

We can arrange this for you where necessary and will be detailed on the invoice
By Thai Law only 12 passengers are allowed per Private Minivan
Any groups over 12 people (including children and babies) will need to have additional transport until the group size is covered

NB: We take all reasonable care to ensure that the company we deal with offers a High Quality and Safe service. Should this not be your experience, please advise us so we can take steps to resolve the problem and ensure that our standards are kept.

LEGAL TERMS

This agreement is subject to the laws of the country in which the yacht is chartered.
Should one part of this agreement be deemed invalid, the effectiveness of the remaining regulations is not affected.

COMPLAINTS PROCEDURE

The complainant must contact the Owner/ Broker all reasonable time and effort in order to resolve the complaints
Complaints must be of a reasonable nature to be jusdged by the Owner/ Broker
Any complaints concerning the yacht or the Owner/Broker must be documented immediately on completion of the charter at the port of redelivery.
Any Refunds or Guestures of good will are at the descretion of the Owner/ Broker

DAMAGE POLICY

Clients are liable for any and all damage they may do to the yacht and its property during the charter.
